Topgyal Zongkha's appointment as Kalon remains unaccepted by top court

DHARAMSHALA, March 30: The Speaker of the Tibetan parliament-in-exile Pema Jugney in his concluding remarks of the 7th session yesterday made it known that the recent appointment of the former Cabinet Secretary Topgyal Tsering Zongkha as Kalon remains unaccepted by the Tibetan Supreme Justice Commission (SJC).

Tsering’s appointment as Kalon in the 15th cabinet was declared after the voting on March 22.

Of the 43 members present, 21 voted yes, 18 voted no, with 1 blank and 2 invalid votes.

The Speaker announced before the voting that securing 21 votes would qualify for the appointment. When the vote count was 21, the speaker didn’t cast his secret ballot considering it decided in favour of the appointment and declared the nominee appointed.

The decision was based on the premise that 50% of the votes would mean 21.5 and 21 was considered sufficient as per the direction of article 49 of the charter that says decimals may be not taken into account in such voting.

The speaker had expressed confidence in his decision when Tibetan media personnel asked about other possible interpretations the same day.

It was learnt that the SJC also wrote to the Speaker the same day.

The SJC argues in its refusal that securing 21 votes out of 43 amounts to 48.8% and not 50%, the benchmark for appointment as enshrined in the provision of article 86 of the charter of Tibetan government-in-exile.

The Speaker continues to say he doesn’t see how it was wrong, as the same method has been employed in the past.
